1. Object

These general conditions regulate the purchase of products by Users through www.allblackwines.com from CASAS DE LO ALTO SL (ALLBLACK WINES), with registered office at C/ Colón, 28 – 13,700 Tomelloso (Ciudad Real) and CIF B-13499645, hereinafter ALLBLACK WINES.

2. Acceptance of the General Conditions

When buying any of our products offered on this website, the buyer expressly states that he has read, understood and accepts without reservation the general conditions of the contract, as well as the particular conditions that may be established. All general conditions will be permanently available to Users prior to contracting and may be stored and reproduced and printed in the version in force at any time. These conditions will have an indefinite period of validity, ALLBLACK WINES reserving the right to modify them unilaterally, without this affecting the goods or promotions that were acquired prior to the modification. For this reason, it is convenient that each time the website is accessed, the current conditions are checked at all times. The contract will not be archived and will be written in Spanish.

3. Where do we serve?

ALLBLACK WINES only sends its products to Peninsular Spain, so it will not be possible to place an order to a destination other than those indicated. We do not ship to the Balearic Islands, Canaria, Ceuta and Melilla.

 

4. Who Can Hire

Our products are not sold, supplied or delivered to persons under the age of 18.

It is expressly warned that the purchase is prohibited to persons under 18 years of age.

In order to purchase any of the products offered on our website, the purchaser declares and guarantees that they and, where appropriate, the person to whom the products are to be delivered reside in a country where we serve our products and are not under 18 years.

In the event that a legal entity is contracted, the person acting on its behalf declares under its responsibility that it has valid powers to do so, ALLBLACK WINES reserving the right to verify this point.

 

5. Communication with the Client

Communications with the buyer will be made preferably by email, so you must provide active data at all times for this purpose.

6. Order Confirmation 

When we receive your order, we will proceed to confirm it by email at the address you have provided us with, within 24 hours, sending you an acknowledgment of receipt that will indicate the order number and contain the general conditions and, where appropriate, the specific conditions of the contract.

7. Availability of Products

In the event that a product is not available, we will notify you as soon as possible through the data you have provided so that you can replace it with another or cancel the purchase at your option.

8. Delivery of Orders and Shipping Costs

Orders will be delivered to the address that you have indicated, located within the geographical scope of the territory where we serve our products.

ALLBLACK WINES will adopt the measures required of a diligent merchant so that the delivery can be made within the agreed time, although it does not assume any responsibility if this cannot be done as a result of the data provided being false, inaccurate or incomplete or when the delivery is not may be carried out for reasons beyond the control of the shipping company, assigned for this purpose, or due to the absence of the recipient. In such cases, the contract will be understood to be terminated and we will be able to claim the transport and shipping costs derived from the failed delivery of the order due to causes beyond our control.

The cost of shipping costs will depend on the destination as well as the quantity of products, and will be detailed in the purchase process.

9. Means of Payment and Billing

Payment can be made by credit card through the secure payment gateway, in which the bank that issued the card will verify the identity of the cardholder and its authenticity before authorizing the payment, as well as of customer data protection. In this way, we also at no time have your financial data, which provides greater security to the payment process.
Any incident that may arise will be the responsibility of the issuer, and the client must contact the bank in question.
The user expressly consents to be issued an electronic invoice in pdf form and may revoke consent at any time by sending a letter to that effect to info@allblackwines.com.

 

10. Right of Withdrawal

1. If you are a consumer or user, you have the right to withdraw from this contract within a period of fourteen calendar days without the need for justification, from the day that you or a third party that you have indicated to us, other than the carrier, acquires material possession of the requested goods.

Exceptions to the right of withdrawal:
– In the case of articles that have been unsealed after delivery and are not suitable for reasons of hygiene or health.

2. Exercise and consequences of the right of withdrawal.

2.1. Before the withdrawal period expires, you must unequivocally notify us of your decision to withdraw from the contract to CASAS DE LO ALTO SL (ALLBLACK WINES), C/ Colón, 28 – 13700 Tomelloso (Ciudad Real), info@allblackwines.com. To comply with the withdrawal period, it will be sufficient for the communication exercising the right to be sent before the corresponding period expires.

2.2. Exercised the right of withdrawal within the indicated period, before fourteen calendar days have elapsed from the date on which you had informed us of the decision to withdraw from the contract, we will proceed to reimburse you for any payment that we would have received from you through the same means that you would have used. to pay for the order, unless you have expressly provided otherwise, not incurring any expense as a result of the refund. The reimbursement would be, where appropriate, the delivery costs, unless you had selected a delivery method other than the least expensive ordinary delivery method, in which case we will not reimburse the additional costs derived from it.

23. Unless we offer to collect the goods ourselves, we may withhold reimbursement until we have received the goods or until you provide us with proof of return of the goods, whichever condition is met first.

2.4. You are informed that you will bear the direct costs of returning the products.

2.5. You will only be responsible for the decrease in the value of the goods resulting from a manipulation of the same other than that necessary to establish its nature, its characteristics or its operation.

 

11. Guarantees and Refund in Case of Non-Conformity

The buyer must check the quantity and quality of the products purchased as soon as they are received, and must notify us and describe without undue delay any lack of conformity of the product.

When the purchased product is defective, you must inform us of it at the time you became aware of it and within a maximum period of two months, by sending an email to info@allblackwines.com indicating the defects observed.

In such case, you may choose to refund the price or replace the defective product whenever possible and proportionate. If you opt for replacement and the product does not conform, the return costs will be borne by us.
When the product arrives in poor condition due to transport, you must indicate it on the carrier’s delivery note and notify us within 24 hours of receipt to make the appropriate claim.

Actions against the producer and/or manufacturer. As provided by law, also as a consumer claim directly to the producer and / or manufacturer to obtain restitution or repair of the good.
